1. Agreement to Terms
By accessing our website, applying for or enrolling in any program, or using any service offered by By Any Means Basketball, LLC ("BAM," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.
These Terms apply to all visitors, users, athletes, parents, guardians, coaches, and any other persons who access or use our services.
2. Description of Services
By Any Means Basketball provides basketball training, coaching, development programs, camps, clinics, and related services, including but not limited to:
• The Summer Academy at DETAIL Miami
• The ADAPT AAU Experience
• College and professional player development programs
• Global camps, clinics, and coaching projects
• Virtual Academy and online training content (one-time and subscription-based)
• Merchandise and branded products
We reserve the right to modify, suspend, or discontinue any service at any time with or without notice.
3. Eligibility and Registration
To enroll in any BAM program:
• Participants must meet the age and skill requirements specified for each program
• Participants under the age of 18 must have a parent or legal guardian complete registration on their behalf and provide written consent
• All registration information must be accurate, current, and complete
• BAM reserves the right to refuse enrollment at its sole discretion
4. Payments, Fees, Cancellation, and Refund Policy
a) Virtual Academy Products
The following cancellation and refund policy applies specifically to all Virtual Academy products offered by By Any Means Basketball:
One-Time Payment Programs
All one-time payment programs are non-refundable. Once purchased, lifetime access to the program is granted, and no refunds will be issued under any circumstances.
Subscription-Based Programs
All subscriptions are non-refundable, including monthly and annual subscriptions. If you cancel your subscription before the next billing cycle, no additional charges will be made, but no refunds will be provided for the current or past billing periods.
How to Cancel a Subscription
Subscriptions can be canceled by:
• Using the in-app messaging system
• Sending an email to [email protected]
Please allow up to 48 hours for cancellation requests to be processed. If a cancellation request is submitted before the next renewal date but processed after renewal, the renewal charge will be refunded.
Important Notes
• It is the customer's responsibility to ensure that cancellation requests are submitted in advance of the renewal date to avoid charges
• Refunds will only apply to charges made after a cancellation request has been received but before it was processed, provided the request was made prior to the renewal date
• Refunds are not available for any period where the subscription has already been active and accessible
b) In-Person Programs (Camps, Academies, and Training)
The following refund schedule applies to all in-person BAM programs, camps, and training experiences:
• Refund requests made more than 30 days before a program start date: full refund minus a $100 administrative fee
• Refund requests made 15–30 days before a program start date: 50% refund
• Refund requests made fewer than 14 days before a program start date: non-refundable
• No refunds for early departures, voluntary withdrawals after a program begins, or dismissals due to code of conduct violations
• If BAM cancels a program, participants will receive a full refund or credit toward a future program
c) General Payment Terms
• All fees are due as specified at the time of registration or enrollment
• We accept payment via the methods listed on our website and registration forms
• Prices are subject to change without notice; enrolled participants will not be affected by price changes after payment is confirmed
d) Chargebacks
Initiating an unauthorized chargeback or payment dispute will result in immediate suspension from all BAM programs and services. We reserve the right to pursue recovery of disputed amounts through all available legal means.

5. Code of Conduct
All participants, parents, and guardians are expected to:
• Treat coaches, staff, fellow athletes, and all program participants with respect
• Follow all rules, schedules, and instructions provided by BAM staff
• Refrain from any form of harassment, bullying, discrimination, or abusive behavior
• Abstain from the use of alcohol, drugs, or any prohibited substances during BAM programs
• Take responsibility for personal belongings and property
BAM reserves the right to remove any participant from a program without refund for violations of this code of conduct, as determined at our sole discretion.
6. Health, Safety, and Medical
By enrolling in any BAM program, participants and their guardians represent and warrant that:
• The participant is physically fit and able to participate in athletic training activities
• Any known medical conditions, allergies, injuries, or physical limitations have been disclosed to BAM staff prior to participation
• The participant has received medical clearance to participate in intensive physical activity where required
BAM staff are not licensed medical professionals. In the event of an injury or medical emergency, BAM staff will contact emergency services and attempt to reach the participant's emergency contact. Participants and guardians are responsible for maintaining appropriate health insurance coverage.
7. Assumption of Risk and Waiver of Liability
PARTICIPATION IN BASKETBALL AND ATHLETIC TRAINING ACTIVITIES INVOLVES INHERENT RISKS OF PHYSICAL INJURY. BY ENROLLING IN ANY BAM PROGRAM, PARTICIPANTS AND THEIR GUARDIANS VOLUNTARILY ASSUME ALL SUCH RISKS.
TO THE FULLEST EXTENT PERMITTED BY LAW, BAM, ITS OWNERS, OFFICERS, EMPLOYEES, COACHES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, DAMAGE, OR EXPENSE ARISING FROM OR RELATED TO PARTICIPATION IN ANY BAM PROGRAM, INCLUDING BUT NOT LIMITED TO INJURIES SUSTAINED DURING TRAINING, GAMES, TRANSPORTATION, OR OTHER PROGRAM ACTIVITIES.
A separate liability waiver and medical authorization form may be required prior to participation in any in-person program.
8. Photography, Video, and Media Release
By participating in any BAM program, participants and their guardians grant By Any Means Basketball a non-exclusive, royalty-free, worldwide license to use photographs, videos, and other media captured during program activities for marketing, promotional, educational, and social media purposes.
If you do not wish to be featured in BAM media, you must notify us in writing prior to the start of the program. This does not affect eligibility for enrollment.
9. Intellectual Property
All content on the BAM website and in our programs — including text, graphics, logos, videos, training methodologies, curricula, and materials — is the intellectual property of By Any Means Basketball, LLC and is protected by applicable copyright and trademark laws.
You may not reproduce, distribute, modify, or create derivative works from any BAM content without our prior written consent. Unauthorized use of our intellectual property is strictly prohibited.
10. Third-Party Services and Links
Our website and programs may include links to or integrations with third-party platforms such as payment processors, booking systems, and social media. BAM is not responsible for the content, privacy practices, or terms of any third-party service. Your use of third-party services is subject to their respective terms and policies.
11. Termination
BAM reserves the right to suspend or terminate your access to our services, website, or programs at any time for any reason, including but not limited to violations of these Terms, fraudulent activity, or conduct detrimental to the organization or its participants.
12. Disclaimers
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
RECRUITMENT OUTCOMES: BAM makes no guarantees regarding college or professional recruitment.
Any connections to college coaches or programs are provided at the sole discretion of BAM staff and only when athlete performance and conduct warrant such introductions.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BAM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In any event, BAM's total liability to you for all claims arising from or related to our services shall not exceed the total amount paid by you to BAM in the twelve (12) months preceding the claim.
14. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, United States of America, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or your use of BAM services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Miami-Dade County, Florida, in accordance with the American Arbitration Association's rules.
15. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Updated terms will be posted on our website with a revised effective date. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
